The process of issuing building permits in the Municipality Novi Grad Sarajevo

The investor wants to perform some of the following work:

 

Step 1

– construction of the object;

– reconstruction of the object;

– upgrade the objects (adding floors to the top of the existing building);

– other subsequent works on the existing building;

– change of use (e.g. changes from housing to business object), or

– construction of transport, utility and energy infrastructure or its part.

Step 2.

The investor shall obtain from the competent authority three different permits, namely:

   -I- Urban planning permit

  -II- Building permit

 -III-  Use permit

Step 3.

Application for Urban Planning Permit (to be obtained at the info desk in the Municipality building)

Step 4.

The application shall be submitted to the Department of Urban Planning, Property and Legal, Geodetic Affairs and Real Estate Cadastre of Novi Grad Sarajevo, and must contain the following documents:

Information about the parcel of land:

– Copy of cadastral plan (not older than 6 months, original or certified copy)

–  Land registry entry document (ZK izvadak) as proof of ownership of the land on the name of the applicant (not older than 6 months, original or certified copy) and/or in cases where the land registry entry does not contain the name of the applicant as the owner of the land – contract or pre-contract as proof of the right of ownership of land subject / object, notarized consent of the registered owner/possessor or other proof of resolved property-legal relations (original or certified copy).

  • Preliminary project consisted of: technical specifications; all the layout of the building; sections and elevations,
  • Environmental permit (if it is required by the Environmental Protection Act)
  • The administrative fee in the amount of 30.00 KM under heading 21 of the Law on Administrative Fees (“Official Gazette of Sarajevo Canton”, No. 30/01, 22/02, 10/05, 26/08, 23/16) or proof of exemption from payment of administrative fees in accordance with Article 8 and 9 of the Law on administrative fees (“Official Gazette of Sarajevo Canton” No: 30/01, 22/02, 10/05, 26/08, 23/16 ).

Step 5.

Once an investor obtains a final and binding urban planning permit, it is necessary to submit the request for approval for building (building permit) to the municipal authority.

Step 6.

The request for issuing building permits shall be accompanied by:

  • The urban planning permit with final force and effect;
  • Evidence of the construction right (under the law, proof of the right to construct is the following:

– ownership confirmed by a copy by the land register,

– the court judgment  with final force and effect or the decision with final force and effect of the competent authority on the basis of which an investor acquired the right of ownership or building,

–  the decision with final force and effect  on granting the land to the investor for using with the purpose of construction of the building based on the urban planning permit,

– partnership agreement concluded with the owner of the land and/or owner of the real estate whose goal is shared building,

– the concession agreement by which the right to build is  acquired,

– an agreement under which an investor acquired the right of the ownership or building.

  • Project documentation to verify and check whether it corresponded to the issued urban – technical conditions (two copies);
  • Updated cadastre of underground installations with marked location of the object,
  • Approval of the Cantonal public utility companies,
  • Land registry entry document (not older than 6 months, original or certified copy);
  • A copy of the cadastral plan (not older than 6 months, original or certified copy)
  • Proof of the regulated issue of the land construction;
  • Proof of the regulated issue of compensation for the convenience of the location – rents (under the proof of regulated issue of compensation for the convenience of the location – rents it is considered:

– a) a copy of the determined fee for the convenience of the location – rents, with an attached payment slip, or

– b) a copy of the decision of the BIZ Service on exemption from payment in accordance with the additional rights of veterans);

  • Proof of the regulated issue of shelters (this implies the following):

– a) a copy of the decision about the determined fee for the release of building shelters with an attached payment slip of the payment of determined fees, or

– b) a decision which gives the consent for project documentation issued by the Committee from the aspect of the shelter;

  • Other documentation specified in the decision of urban planning permit;
  • Administrative fee amounting to 8,00 KM; the final amount of the administrative fee will be calculated in the process of issuing building permit when the value of the building will be determined, but the maximum amount is 150,00 KM in accordance with the heading 24 of the Law on Administrative Fees.

Step 7.

In addition to the request for the issuance of building permits, which shall be filed within one (1) year from the date after the urban permit becomes legal with final force and effect, the investor is shall submit to the Department of Urban Planning, Property and Legal, Geodetic Affairs and Real Estate Cadastre of Novi Grad Sarajevo the following requirements:

▪ Application for calculation of the fee for the convenience of the location – the rent,

▪ Request for regulation of the shelter, which can be regulated in two ways:

– by request for release of constructing the shelter, with established payment fees, or

– Request for exemption from payment of fees for the release of the construction of the shelter.

Step 8

Use permit is a decision which is issued on the basis of a building permit, which allows registration of ownership of the building at the Land Registry Entry.

After the investor obtains urban permit, building permits and builds the building in accordance with the aforementioned permit, it is necessary to fill the request for technical inspection of the building and use permit to the Department of Urban Planning, Property and Legal, Geodetic Affairs and Real Estate Cadastre of Novi Grad Sarajevo, and submit the following:

  • The urban planning permit with final force and effect (copy),
  • The building permit with final force and effect (copy),
  • A copy of the cadastral plan (not older than 6 months, original or certified copy)
  • Land registry entry document (not older than 6 months, original or certified copy)
  • Other documentation which can be established as necessary during the administrative procedure.
